PRIVACY AND PERSONAL DATA PROTECTION POLICY

This Privacy and Personal Data Protection Policy (“this Policy”) is issued to all immediate and/or prospective customers, suppliers, and employees of M Xpress and its group of companies (“M Xpress”) in compliance with the Personal Data Protection Act 2010 (“the Act”).

In accordance to Section 7(3) of the Act, this Policy is issued in both English and Bahasa Malaysia languages. The Bahasa Malaysia version of this Policy can be retrieved from here. In the event of any inconsistency or conflict, the English version shall prevail.

    For the purposes of this Policy, please note that:
  • “M Xpress” refers to M Xpress Sdn Bhd (Formerly known as Sure-Reach Worldwide Express Sdn Bhd) and all its related companies, as defined in Section 6 of the Companies Act 1965.
  • “Personal information” refers to any information which relates directly or indirectly to you and/or your transactions with us. This information includes but not limited to your name, address, contact details, the type of products and/or services subscribed to and such other necessary information regarding yourself and your transaction(s) with us. For the avoidance of doubt, please note that this Policy is applicable only if you are an individual.

1. What Personal Data Do We Collect?

In the course of your dealings with M Xpress, we may request you to provide personal information such as your name, identity card/passport number, address, nationality, contact information, e-mail address, and other pertinent information to enable us to enter into commercial transactions with you, or to deliver the necessary notices, services and/or products in connection with our business.

2. How Do We Collect Your Personal Data?

M Xpress may have collected, recorded, used, disclosed and stored your personal information which could have been obtained from various sources, including but not limited to:

  • Information provided in application forms and/or consignment notes when using our services, taking part in our surveys, or when submitting forms through any online or offline channel;
  • Your verbal and written communications with us and/or our authorised agents;
  • Information from third parties connected with you; and
  • Information from other public sources which you have consented to be disclosed.

3. What Do We Use Your Personal Data for?

All personal data collected by M Xpress may be used for the following purposes (“the Purpose”):

  • To enable delivery of notices and services and/or products;
  • To upkeep our database and records;
  • To prepare and execute all necessary documents and agreements and/or contracts;
  • To perform credit assessments, financial and background investigation as and when deemed necessary;
  • To meet any legal or regulatory requirements related to our provision of services; and
  • To disclose your personal information to relevant parties.

4. To Whom Do We Disclose Your Personal Data?

M Xpress will not trade or sell your personal data to third parties. Your personal data shall only be disclosed or transferred to the following third parties who may be located within or outside Malaysia, strictly for the fulfilment of the Purposes as listed in point 3 above:

  • Other M Xpress subsidiaries and any other parties and/or business partners that M Xpress contracts with;
  • Other third parties as may be deemed necessary by M Xpress in order to process your commercial transactions and facilitate your dealings with us;
  • M Xpress’ auditors, consultants, lawyers, accountants or other financial or professional advisers appointed in connection with our business;
  • Legal bodies as permitted or required by law to comply with a warrant or subpoena issued by a court of competent jurisdiction;
  • Parties authorised by you; and
  • Any parties that M Xpress may think fit.

M Xpress shall take practical steps to ensure that all its employees, contractors and such other third parties mentioned above who are directly or indirectly involved in the collection, recording, use and disclosure of your personal data will observe and adhere strictly to the terms of this Policy.

5. Rights of Access and Correction

You may make a request to access, review, amend and correct your personal information by writing to:

M Xpress reserves the right to refuse such a request if the request is irrelevant to the business.

6. How Long May We Retain Your Personal Data?

The personal data collected will be retained by us for the duration permitted/ required under Malaysian law, which may extend to periods after termination of contractual relationship with us. We will not retain your personal data longer than necessary for the fulfilment of the Purpose. M Xpress shall take all reasonable steps to ensure that all personal data is destroyed or permanently deleted when no longer required for the Purpose.

7. Notification of Changes

Please note that this Policy may be amended from time to time in accordance to applicable laws and regulations and such variations may be applicable to you. This Policy is not intended to, nor does it, create any contractual rights or obligations on M Xpress in respect of any other party or on behalf of any party. M Xpress will post all changes to this Policy in their website mxpress2u.com.

POLISI PRIVASI DAN PERLINDUNGAN DATA PERIBADI

Polisi Privasi dan Perlindungan Data Peribadi (“Polisi ini”) diisukan kepada semua pelanggan atau bakal pelanggan, pembekal, dan pekerja M Xpress dan kumpulan syarikatnya (“M Xpress”) dengan mematuhi Akta Perlindungan Data Peribadi 2010 (“Akta”).

Mengikut Seksyen 7(3) Akta berkenaan, Polisi ini diterbitkan dalam Bahasa Inggeris dan Bahasa Malaysia. Sekiranya terdapat sebarang ketidakselarasan atau percanggahan, versi Bahasa Inggeris akan diguna pakai.

    Untuk keperluan Polisi ini, sila ambil perhatian bahawa:
  • “M Xpress” merujuk kepada M Xpress Sdn Bhd (Dahulunya dikenali sebagai Sure-Reach Worldwide Express Sdn Bhd) dan syarikat-syarikat yang berkaitan dengannya, sebagaimana yang ditakrifkan dalam Seksyen 6 Akta Syarikat 1965.
  • “Maklumat peribadi” merujuk kepada apa-apa maklumat yang berkaitan secara langsung atau tidak langsung kepada anda dan/atau transaksi anda dengan kami. Maklumat ini termasuk tetapi tidak terhad kepada nama, alamat, butiran perhubungan, jenis produk dan/atau perkhidmatan yang dilanggandan apa-apa maklumat lain mengenai diri anda dan transaksi-transaksi anda dengan kami. Bagi mengelakkan sebarang keraguan, sila ambil perhatian bahawa Polisi ini terpakai hanya jika anda merupakan seorang individu.

1. Apakah Data Peribadi Yang Kami Kumpul?

Dalam pengurusan anda dengan M Xpress, kami akan meminta anda untuk memberikan maklumat peribadi seperti nama, nombor kad pengenalan/nombor pasport, alamat, kewarganegaraan, butiran perhubungan, alamat e-mel, dan maklumat penting yang lain yang membolehkan kamiuntuk berurus niaga dengan anda atau untuk menyampaikan notis-notis yang berkaitan, perkhidmatan-perkhidmatan dan/atau produk-produk yang berkaitan dengan perniagaan kami.

2. Bagaimanakah Kami Mengumpul Data Peribadi Anda?

M Xpress akan mengumpulkan, merekodkan, menggunakan, mendedahkan dan menyimpankan maklumat peribadi anda yang boleh didapati daripada pelbagai sumber, termasuk tetapi tidak terhad kepada:

  • Maklumat yang diberikan di dalam borang-borang permohonan dan/atau nota konsainan apabila menggunakan perkhidmatan-perkhidmatan kami, semasa mengambil bahagian dalam kaji selidik kami, atau apabila mengemukakan borang melalui mana-mana saluran dalam talian atau luar talian;
  • Komunikasi lisan dan bertulis anda dengan kami dan/atau ejen yang telah diberikan kuasa oleh kami ;
  • Maklumat daripada pihak ketiga yang berkaitan dengan anda; dan
  • Maklumat daripada sumber-sumber awam, di mana anda telah memberikan kebenaran untuk mendedahkan maklumat yang berkaitan dengan anda.

3. Bagaimanakah Kami Menggunakan Data Peribadi Anda?

Semua data peribadi yang di kumpul oleh M Xpress akan digunakan bagi tujuan-tujuan yang berikut (“Tujuan”):

  • Untuk menyampaikan notis penghantaran dan perkhidmatan dan/atau produk;
  • Untuk mengekalkan pangkalan data dan rekod pelanggan;
  • Untuk menyediakan dan melaksanakan semua dokumen dan perjanjian dan/atau kontrak yang berkaitan;
  • Untuk melaksanakan penilaian kredit, penyiasatan kewangan dan latar belakang apabila dianggap perlu;
  • Untuk memenuhi apa-apa kehendak undang-undang atau peraturan yang berkaitan dengan peruntukan perkhidmatan-perkhidmatan kami; dan
  • Untuk mendedahkan maklumat peribadi anda kepada pihak yangberkenaan.

4. Kepada Siapa Kami Dedahkan Data Peribadi Anda?

M Xpress tidak akan mendagangkan atau menjual maklumat peribadi anda kepada pihak ketiga. Maklumat peribadi anda hanya akan didedahkan atau dipindahkan kepada pihak-pihak berikut yang mungkin berada di dalam atau di luar Malaysia untuk memenuhi Tujuan tersebut:

  • Lain-lain anak syarikat M Xpress dan mana-mana pihak lain dan/atau rakan kongsi perniagaan M Xpress;
  • Pihak ketiga yang lain sebagaimana yang difikirkan perlu oleh M Xpress untuk memproses transaksi komersial dan memudahkan urusan anda dengan kami;
  • Juruaudit, perunding, peguam, akauntan atau penasihat kewangan atau profesional yang dilantik berhubung dengan perniagaan M Xpress;
  • Badan berkanun yang dibenarkan atau dikehendaki oleh undang-undang sebagai mematuhi waran atau sepina yang dikeluarkan oleh mahkamah yang mempunyai bidang kuasa berwibawa;
  • Pihak-pihak yang diberi kuasa oleh individu; dan
  • Mana-mana pihak yang M Xpress fikir ia bersesuaian.

M Xpress akan mengambil langkah-langkah praktikal untuk memastikan bahawa semua pekerja, kontraktor dan mana-mana pihak ketiga lain yang tersebut di atas yang terlibat secara langsung atau tidak langsung dalam mengumpul, merekodkan, menggunakan dan mendedahkan data peribadi anda akan mematuhi sepenuhnya syarat-syarat Polisi ini.

5. Hak Mengakses dan Pembetulan Data

Anda boleh membuat permintaan untuk mengakses, mengkaji semula, meminda dan membetulkan maklumat peribadi anda dengan menulis kepada:

M Xpress berhak untuk tidak melayan sebarang permintaan yang tidak berkaitan dengan urusan perniagaan.

6. Berapa Lamakah Kami Boleh Menyimpan Data Peribadi Anda?

Data peribadi yang dikumpulkan akan disimpan oleh kami untuk jangka masa yang dibenarkan/ diperlukan di bawah undang-undang Malaysia. Ini termasuk penyimpanan sehingga tempoh selepas penamatan hubungan kontrak dengan kami. Kami tidak akan menyimpan data peribadi anda melebihi masa yang diperlukan untuk memenuhi Tujuan tersebut. M Xpress akan mengambil segala langkah yang munasabah untuk memastikan bahawa semua data peribadi dimusnahkan atau dipadamkan secara kekal apabila tidak lagi diperlukan untuk Tujuan tersebut.

7. Pemberitahuan Perubahan

Sila ambil perhatian bahawa Polisi ini boleh dipinda dari semasa ke semasa selaras dengan undang-undang dan peraturan dan apa-apa perubahan yang berkaitan dengan anda. Polisi ini tidak bertujuan untuk mewujudkan apa-apa hak kontrak, atau tanggungjawab pada M Xpress bagi menghormati mana-mana pihak atau mewakili mana-mana pihak. M Xpress akan menerbitkan semua perubahan bagi Polisi ini di laman sesawang mereka mxpress2u.com.

STANDARD CONDITIONS OF CARRIAGE

A) Terms of Reference:

  • 'Company' – refers to M XPRESS SDN. BHD. (Formerly known as Sure-Reach Worldwide Express Sdn. Bhd.), its employees and network members.
  • Consignments' – refers to the documents or/and parcels (or goods) to be transported or carried by the Company through its various means. The Company shall not be held liable for failure to execute its obligations directly or indirectly occasioned or in consequence of wars, strikes, riots and acts of God and/or conditions beyond the control of the Company. Save for the exceptions provided in clauses 8-10, the Company shall NOT be liable for losses and damages of any consignments handled by them, howsoever caused. Clients are therefore strongly advised to secure insurance cover for their consignments.

B) Validity:

  1. Any business undertaken by the Company is carried out subject to the conditions set forth in this Standard Conditions of Carriage unless excepted or varied in writing and signed by an authorised personnel of the Company.
  2. The Company is NOT a common carrier and will only carry consignments in accordance to the terms and conditions stated herein.

C) Restriction of Carriage:

  1. Prohibited Items: The Company will not carry illegal, dangerous, hazardous, combustible or explosive material, perishables, heat sensitive items, livestock or plants, poison and drugs, precipitates, precious metal, precious or semi-precious stones, cash and cash equivalent, currency (paper or coin), financial certificates, antiques, priceless work of art and corpses. In the event any clients should consign such items with the Company, the client shall indemnify the Company for all claims, damages and expenses arising in connection therewith and the Company shall have the right to deal with such consignment as it deems fit including the right to abandon carriage of the same immediately upon having knowledge of consignment which infringes this condition. The right of inspection referred to in clause 6 shall also apply for the purposes of this clause.
  2. Ownership and Rights to Consign: The client warrants that it is authorised to accept and is accepting these conditions on behalf of all other persons who are or may have interest in the consignments and hereby undertake to indemnify the Company against any damages, costs and expenses resulting from any breach of this warranty.

D) Company's Rights, Responsibilities and Liabilities:

  1. Rights to Handling Procedures: The Company undertakes (subject to terms of payments and rates notified to the clients from time to time), to manage and carry consignments from its clients in accordance to its own systems and procedures of handling, storage and transportation modes and is under no obligation to divulge any information of its handling procedures to its clients.
  2. Inspection Rights: The Company reserves the rights to inspect all consignments to assess if they are capable of carriage to the places of destination. Nevertheless, the Company does NOT warrant that any consignment carried is capable of carriage without infringing the law of any countries through which the consignment may be carried.
  3. Rights to Refuse Carriage: The Company reserves the right to refuse carriage of any consignments at its absolute discretion without any obligation to provide the reason thereof.
  4. Rights to Pending Items: The Company reserves the option to sell / dispose / return any consignments which cannot be delivered, or were not collected or not accepted by the consignee any time after a maximum of 30 days from date notice is given to the sender of the failed delivery. Any communication or correspondence from the Company to inform that the goods cannot be delivered shall be conclusive evidence of the fact. All charges and expenses arising in connection with the sale, disposal or return of the goods shall be paid by the client. No residual value shall be paid to the client.
  5. Liability of the Company: The Company is responsible to handle all consignments with care whilst they are within its custody and control. Notwithstanding this and subject to clauses 9 and 10 hereof, the Company shall compensate the client for damaged or missing consignments only when it is caused by the Company’s negligence whilst the consignment is in its custody.
  6. No Liability on Consequential Loss: The Company is not responsible to compensate for any nature of consequential losses. The Company shall not be liable for any loss or damage incurred by the client due to any delays in the carriage which are beyond the control of the Company.
  7. Extent of Liability: In respect of the Company's compensation for damaged or missing consignments as provided in clause 8 above. It shall be limited to the lower of replacement costs or RM200.00 per Consignment Note. Notwithstanding this, the Company is under no obligation to provide any compensation in the event the client has overdue amounts still unpaid to the Company.
  8. Claims Procedures: Any claim brought against the Company must be notified in writing to the office of the Company within 24 hours from the day when the consignment should have reached their destination.
  9. Others: The Company herein acts as agents for its clients when consigning shipments for onward carriage. Without prejudice to its general right of subrogation hereunder, the Company shall have the right to recover compensation from these carriers for losses, damages or expenses incurred by the clients or/and the company.

E) Client's Responsibilities:

  1. Non-compliance: The client shall assume full liability for all loss, damages and expenses arising as a result of its failure to comply with its obligations under this Agreement or as a result of its negligence.
  2. Default of Payments by Client: The client acknowledges that the Company is involved in the business of transportation of goods and agrees to honor and pay the Company in accordance to agreed payment terms. Should the client default in payment, the Company reserves the right to suspend all services, retain all consignments in its custody and take all other necessary actions to recover the overdue payments.
  3. Default of Payments by Receiver: Should the client instruct that the receiver be liable for payments for the carriage or customs taxes, then the client shall be liable for such payments in the event of default by the receiver.
  4. Compounds and Penalties: The Company is not liable for any penalties, loss or damage of consignments incurred due to the consignments being impounded by customs or similar authorities and the client agrees to indemnify the Company for any expenses incurred.
  5. Packaging: It is the sender’s responsibility to ensure that the consignments are adequately and properly packed and the Company shall not be held accountable for consequences caused by inadequate or inappropriate packaging. The Company may carry out additional packaging deemed necessary to enable delivery of the consignment and costs associated with this packaging services shall be borne by the shipper. Notwithstanding this, the Company does NOT warrant that:
    • it shall check the adequacy and appropriateness of the packaging every consignment; and
    • even if the consignments had been re-packed, that it shall arrive and be delivered in good order.
  6. Preparation of Consignment Note: Client must ensure all delivery information including address and contact numbers given on the Consignment Notes is correct and complete, properly and legibly written to enable effective delivery. Wrong or inadequate information given may result in the consignment being charged multiple times and delays in delivery.

DANGEROUS GOODS

    Dangerous goods are substances which pose risk to health, safety, property or the environment during operation and/or transportation. They are divided into classes on the basic of the specific chemical characteristics producing the risk.

    Note: The graphics and text representing the dangerous goods safety marks used on this page are derived from the United Nations-based system of identifying Dangerous Goods. Not all countries use precisely the same graphics (label, placard and/or text information) in their national regulations.

    Classification and Labelling Summary Tables
    Class 1: Explosives

    Information on this graphic changes depending on which, “Division” of explosive is shipped. Explosive Dangerous Goods have compatibility group letters assigned to facilitate segregation during transport. The letters used range from A to S excluding the letters I, M, O, P, Q, and R. The example above shows an explosive with a compatibility group “A” (shown as 1.1A). The actual letter shown would depend on the specific properties of the substance being transported.   • Explosives with a mass explosion hazard. Eg: TNT, dynamite, nitroglycerine.

    Explosives with a severe projection hazard.

    Explosives with a fire, blast or projection hazard but not a mass explosion hazard.

    Minor fire or projection hazard (includes ammunition and most consumer fireworks).

    An insensitive substance with a mass explosion hazard (explosion similar to 1.1).

    Extremely insensitive articles.

  • Class 2: Gases

    Gases which are compresses, liquefied or dissolved under pressure as detailed below. Some gases have subsidiary risk classes; poisonous or corrosive.

  • Flammable Gas
    Gases which ignite on contact with an ignition source.
    Eg: acetylene, hydrogen. Flammable 2

    Non-Flammable Gases
    Gases which are neither flammable nor poisonous.
    Eg: nitrogen, neon. Includes the cryogenic gases/ liquids (temperatures of below -100°C) used for cryopreservation and rocket fuels. Non-Flammable 2

    Poisonous Gases
    Gases liable to cause death or serious injury to human health if inhaled.
    Eg: fluorine, chlorine, hydrogen cyanide. Poison 2

  • Class 3: Flammable Liquids

    Flammable liquids included in Class 3 are included in one of the following packaging groups:

  • Packing Group I, if they have an initial boiling point of 35°C or less at an absolute pressure of 101.3 kPa and any flash point;
    Eg: diethyl ether, carbon disulfide.

    Packing Group II, if they have an initial boiling point greater than 35°C at an absolute pressure of 101.3 kPa and a flash point less than 23°C;
    Eg: gasoline (petrol), acetone.

    Packing Group III, if the criteria for inclusion in Packing Group I or II are not met.
    Eg: kerosene, diesel.
    Note: For further details, check the Dangerous Goods Transportation Regulations of the country of interest.

  • Class 4: Flammable Solids
  • Flammable solids which are easily ignited and readily combustible.
    Eg: nitrocellulose, magnesium, safety or strike-anywhere matches. Flammable 4

    Spontaneously combustible substance.
    Eg: aluminum alkyls, white phosphorus. Combustible 4

    Substances which emit a flammable gas when wet or react violently with water.
    Eg: sodium, calcium, potassium. Wet 4

  • Class 5: Oxidizing Agents & Organic Peroxide
  • Oxidizing agents other than organic peroxides.
    Eg: calcium hypochlorite, ammonium nitrate, hydrogen peroxide, potassium permanganate. Oxidizer 5

    Organic peroxides, either in liquid or solid form.
    Eg: benzoyl peroxides, cumene hydroperoxide. Peroxide 5

  • Class 6: Toxic and Infectious Substances
  • Toxic substances which are liable to cause death or serious injury to human health if inhealed, swallowed or by skin absorption.
    Eg: potassium cyanide, mercuric chloride, hydrofluoric acid. Poison 6

    (Now PHIII) Toxic substances which are harmful to human health
    (N.B this symbol is no longer authorized by the United Nations).
    Eg: low toxicity pesticides, methylene chloride.

    Biohazardous substance.
    Eg: Virus cultures, pathology specimens, used intravenous needles.
    Divided into two categories by the WHO: Cat. A (infectious) and Cat. B (samples). Infectious 6

  • Class 7: Radioactive Substances
  • Radioactive substances comprise substances or a combination of substances which emit ionizing radiation.
    Eg: uranium, plutonium.

    Radioactive 7
  • Class 8: Corrosive Substances

    Solids or liquids that can dissolve organic tissue or severely corrode certain metals.

  • Acids
    Eg: sulfuric acid, hydrochloric acid.

    Alkalis
    Eg: potassium hydroxide, sodium hydroxide.

    Corrosive 8
  • Class 9: Miscellaneous Dangerous Substances
  • Hazardous substances that do not fall into the other categories.
    Eg: asbestos, air-bag inflators, self-inflating life rafts, dry ice.
